So, among the crimes that we will be looking at will be adultery, concubinage, acts of laciviousness, qualified seduction, etc. So all of these are classified as crimes against tr just tr justity under the revised penal code. Just to note that the topics that will be discussed in this video are quite sensitive. We will try to look at them and the answers will be within the contents of the video. So it pertains to uh to a person’s sexuality, okay? Being a male, being a female or otherwise or violations of marital vow. So it’s between um married partners. Note that ito very uh very important. Ang rape is no longer under the crime against chassity. before under the old law, rape was under uh under this category, but it has been it has now been reclassified as a crime against person. And moreover, may isa ng klaseng rape na gender free. Dati kasi iyung rape is only between a man and a woman. Now, meron ng rape na between man and a man, a woman and a woman, as long as certain elements will be met. So another essence why it was transferred or why it has been reclassified to a crime against person so that it can be filed it the case can be filed uh x without the other party no or moto proprio or kahit walang complainant. Okay? Kasi ah ang crimes against cestity generally hindi siya magpo-prosper kung walang complainant. So for example, pag ayaw naman ng Hassumand na mag-file ng adultery sa wife ah pinatawad niya so it’s okay. I mean walang walang criminal liability. But then sa it’s a crime against person, the police may file it. The state may prosecute it without even having a complainant. So bago natin uh isa-isahin yung mga crimes against chastity, let’s first delve into sexual assault which is not crimes against chastity by the way again ha. So sexual assault this is kumbaga a newer provision um compared to the old provision of rape. So it involves insertion of an object into the mouth or anal orifice of the victim. So I have a chart here comparing rape bisexual intercourse which is the traditional definition and rape by sexual assault. So the main distinction is that rape bisexual intercourse okay if you can see here the offender must be a man while sa assault the offender can be any person. So parang ah the the lawmakers have this noble objective na iyung rape parang kumbaga they they realize na ah hindi lang ito na nangyayari sa babae. It can happen to any gender or any person regardless of their gender. So the victim can be uh sa a sexual assault can be any gender or any person while sa by sexual intercourse it’s it’s always a woman. Okay. So ang ang in short yung sexual assault is a gender free crime while sexual intercourse or rape by sexual intercourse or RSI is a gender crime. Okay. The main Okay. The the distinction of RSI is penile penetration of the vagina. So there’s genital uh genital penetration while sa RSI or sa RSA sorry there’s insertion of the genital of the male to the mouth of another person or to his analfice okay or insertion of any object or any instrument into the genital or anal orifice of another person. Okay. So insertion ha the common here is insertion while sa RSI is penetration of the the organs of twoes. So yung yung tandaan dito natin isa ring tandaan is sa RSA. Okay. Sa RSA, it’s always the the the perpetrator is always the one who inserted. Okay? The one who inserted. Pag siya yung for example yung suspect or yung your perpetrator is the one who has been inserted to. Okay. Pag siya yung pinasukan, hindi siya uh RSA kasi the law defines ang crime na ito is the one that inserted. So it could be not just in the uh genital genitalia but it could be on the other orifices of the body. Okay? So one case then I think if I can remember iyung object na to can also be uh the fingers. Okay. So once it has been inserted, even walang penile penetration then there’s already rape or RSA. Now how it is accomplished there the similarity between the two is it it it is uh accomplished in a manner where there has been an employment of FTI or force threat and or intimidation. So natabunan lang diyan ‘yung sa RSA but they’re the same. Okay. Mayon din tayong uh new law. I think it was approved or promulgated under the Duterte administration na tinaas yung statutory rate. Meaning ah kahit may consent. Okay. Dati kasi under 12 years old eh. So kahit may consent yan that’s already rape. However, Tinaas ito i think it’s RA16 something. Um ag below 16 even it has the consent of the woman or of the girl then it’s still rape and that is specifically defined or nomin the denominated as statutory rape. Another uh slide last slide para mas malubos nating maunawaan. Okay so how accomplished same din yan variance rule. Sa variance rule. Um, if charged by sexual intercourse at ah na-prove na rape by sexual assault iyung nangyari, hindi siya mako-convict ng sexual assault kasi hindi ito necessarily included, okay, sa charge ‘ ba. Constitutional right, the right to be informed of the nature, okay, of the accusation. So yung accused in-inform siya na ang kanyang ginawa daw ay rape or penile penetration to the vagina. Pero yung na-prove is ah rape bisexual assault. So hindi mag-a-apply yung varian rule kasi napaka iba yung elements ng ah ng dalawang crime. Okay? Isa it could be object insertion. Okay? But yung isa talagang genital. But under the variance rule, pwedeng ma map maove or ma-convict yung accuse ng acts of laciviousness. Kasi yung elements ng acts of laciviousness are necessarily included uh inside or within the accusation of rape by uh sexual intercourse again. Again, ang main elements ng laciviousness are touching with leud design. So syempre ang ag yan yung na-prove na ginawa mo or nagawa ng accus then ah kasama siya or within siya sa sa information kasi yung elements ng rape is it includes ‘ ba touching din it includes the sorry it includes the penetration with the intent no with the intent to penetrate okay so penalty andiyan din yan and then again as as what you’ve said RSI is a gender crime while RSA is a gender free or genderless crime. Okay. Doctrine of absorption. Rape absorbs acts of laciviousness. Okay. If committed by one person, rape will not absorb sexual assault. Okay? Or RSI will not absorb RSA. Also, in RSA, doctrine of absorption is not applicable by default. So let’s go to uh the main topic natin which is crimes against chastity. Ano-ano ba ito? As you’ve said kanina, one of the first crime that may come to your mind is adultery. Ano ba yyung adultery? Sinong makaka-commit nito? Sino yung possible na maging guilty dito? Babae lang ba? Lalaki lang ba? Or both? So the answer is actually both. Okay. It can be committed by a married woman who has sexual intercourse with a man not her husband and by the man who was carnal knowledge of her knowing her to be married. So both babae at lalaki ang pwede maconvict ng adultery. So long na yung lalaki alam niya na ang babae ay may asawa or kasado. So each sexual intercourse constitutes a separate crime. So that’s adultery. What do you call the partner of the married woman? Anong tawag technically or it can be casually it can be or he can be called as the paramore. Okay? Paramore. Can the offended spouse file the complaint against the cheating wife only? The answer is no. The law does not allow na yung kakasuhan lang niya is yung ah babae or ang lalaki lang. So let’s say nahuli niya walang walang permission. Nahuli niya na nag nag-sex sa ibang lalaki. Hindi pwedeng kasuhan niya lang yung lalaki or yung babae yung asawa niya lang. It must be both. The complaint must include both guilty parties if they are alive. Alive. What instance where both are alive but they can no longer be prosecuted? So ano ba yung situation or kondisyon? So ang ang dapat tandaan natin diyan is kung ginent. nagbigay yung husband ng consent na ang kanyang asawa ay makikipag or mag-commit ng adultery or pinatawad niya na yung ah kanyang asawa at ang kanyang kabit or ang kanyang paramore. Okay. Uh if I can remember the reason for the rationality for these uh for this uh legal provision so that ah it all boils down pa rin sa family kasi agag ah hindi ito inallow yyung pardon. So let’s say syempre nag-away sila na nag ah sinagsigawan sila or maybe nagsakitan sila. Pero at the end of the day iyung law will put primacy on the stability of family relation. So ah as long na pinatawad maybe through a written instrument pinatawad ng lalaki ng husband si wife na hindi na siya kumbaga pinatawad niya na yung kanyang ginawang ah cheating. Sabi sa Matthw 528, « But I say to you that everyone who looks at a woman with lostful intent has already committed adultery with her in his heart. So this this was said by this was stated by Jesus Christ. Ah yung point naman dito ni Jesus Christ kasi yung sinasabihan niya dito yung mga Pharisees though kumbaga they are self-righteous akala nila they are already perfect they are already sinless because they have not committed adultery. However, Jesus said that the Yes, that’s the standard of the law. Uh let’s say sa atin din that’s the standard of the revise penal code. But sa law ni God no Jesus said kahit tumingin ka lang at nag-imagine ka lang nakikita mo sa imagine mo eh. No? So, so ‘pag nakita mo sa imagine mo na, you know, sexy at nag-last ka, nag-imagine ka, uh, ginam mo siya or ginamit mo siya sa mind mo then in the sight of God, you have already committed adultery. Yung point dito ni Jesus is that he wants to show us that the standards of God are is perfection and no one is perfect. Even the Pharisees, even the most religious persons in the world, no, they are still they are still sinners. And therefore Jesus said, « Come to me all you are heavilyen, and I will give you rest. » meaning he is the only savior. Jesus saves Jesus. Only Jesus saves. Kumbaga that’s his point, no. Now this let’s look at the second crime which is concubinage. Ano naman yyung concubinage? Concubinage. So kanina babae yyung offender. Dito naman is both pa rin pero primarily sa actions ng husband. So ang husband So kanina makita lang yung babae na nag-sex sa ibang lalaki sa ibang sa hindi niya husband. That’s already a crime. Sa concubinage may specificity talaga. Dapat iyung husband number one, he keeps the concubine or the mistress in the conjugal dwelling. So kanina para more no pag babae naman yyung kabit it’s called mistress. Okay? Naalala niyo yung kung sino yung may 1,000 wives and mistresses or concubines? Si Solomon ‘ ba? Tapos hari pa siya no? Tapos wisest man pa siya. Anyway, if you keep or if the husband keeps a a mistress in their conjugal home, so let’s say family home nila yan. Binili nila ng asawa niya yan or condo. Tapos kung saan sila bed nag humihiga doon niya rin dinadala yung kabit niya. then that’s concubinage. Second is has sexual intercourse with a woman in a with a mistress in a scandalous way. Okay? Under scandalous circumstances. Let’s say ah paano ba? Siguro gamitin mo na lang yung imagine mo eh. Imagine mo kung ano yung mga scandalous circumstances maybe sa taas ng sa public mga ganyan no or sa boarding house na alam ng mga you know and lastly is cohabits with her in any other place. So kung kung mano-notice niyo hindi dito kasama yung one time you know yung one night stand something lang. It has to be cohabiting. Cohabitation in the in the conjugal home or cohabitation somewhere else or in a scandalous manner. So yun yung pagkakaiba ng adultery at concubinage. Okay? Mas kumbaga kumbaga mas mahirap gawin yung concubinage kasi nga scandalous dapat eh. Paano pag secret lang yan? So naalala niyo naalala niyo kanina yung isang question doon sa intro ah nahuli ng ng wife through an investigator. Yung investigator probably nag spy spy espion or I mean nag gumawa ng secret things at nahuli niya may video siya sa hotel. So that’s uh is that scandalous? Okay. Can that be can that be concubinage? So looking at the law um it might not be kasi it does not fall under these three. Hindi niya naman ginkeep sa conjugal dwelling. Hindi niya naman ginocohabit sa ibang lugar. So that’s uh concubinage penalty for concubines. Okay. What’s the penalty? Destiero and then destier is a principal penalty under the revised penal code. So primarily this is banishment. Kumbaga sa Rizal ah what ginawa ko sir Rizal? Exile. Parang ganyan siya. Okay. It they are banished to a specific place and prohibited from entering minimum of 25 km. So let’s say o bawal kang pumunta sa Cebu City within 25 km range of this barangay or Manila or Pasig. Similar to adultery, the offended spouse, in this case, the wife kasi it’s the concubinage. She must file the complaint including pa rin both guilty parties if both of them are alive. And prosecution is barred by consent or pardon. So pag pinatawad niya na uli, same pa rin. Same din sa adultery. Hindi na magpa-prosper yyung kaso. Essence of concubinage is in it involves again keeping or cohabiting scandalously with a woman. a married man cohabiting scandalously with another woman not his wife. Again, this is also a genderbased crime. Proverbs 6:32 although it this speaks about adultery, he who commits adultery lack sense. He who does it destroys himself. So sabi yan ni Solomon, Proverbs kasi no which surprisingly uh nagka-concubine din siya no. Acts of laciviousness article 336. What are acts of laciviousness? So naririnig niyo siguro ito no. Um this might be equated to bastos. Although we have an antibastos law which is uh which is a safe spaces act. I have a video of that too sa channel na to. But acts of laceviousness specifically are committed by any person. So gender free ito. Okay? He commits any act or ludeness against a person with le design. So yung yung distinction or yung ang hallmark nito is may lee design. So acts with le design. So it can be touching, okay? Caressing, okay, physical touch. Hindi pwedeng defense na yan yyung language of love. No, as long as that’s without permission, that’s with low design. Okay, I think kailangan din ilagay dito no i-add dito iyung without permission kasi consent um it’s it’s what differentiates with all the others. So or lacivious conduct. So ano ba yung lacivious conduct? Okay. Touching introduction of an object orifices. So pwede rin parano pwede rin introduction lang pero wala talagang intent to insert. So intentional touching or introduction of an object with the intent to humiliate, harass, gratify sexual desire. So le design. Iyung le design again is the intention to gratify one’s sexual desire or commit an act of indicency with a woman or a man in the case of acts of laciviousness or AOL. So who can file any person the offended party and their or their parents grandparents or guardian? Again what does what distinguishes AOL from just fixation or slander by deed? So dito naman ah ang pagbastos no that’s the presence of new design intend to to gratify sexual desire. So pag kumbaga gusto niyang maparaos okay by touching but without the intent to insert or intend to penetrate. So that’s AOL or acts of laciviousness. Now let’s go to simple seduction. However, may specific talaga yung specific provision yung simple seduction that’s committed by any male person, meaning this is a gender crime who seduces a virgin over 12 and under 18. So parang may minority component ito no by means of deceit. So si in layman’s term may element din yan ng ah deceit ‘ ba panloloko. Sino yung niloko? Babae babae na between 12 to 18. Okay. Um virgin. Ano yung ibig sabihin ng virgin? Malalaman natin yan mamaya no sa I think three slides pa. Pero yung word na si is to enticing a woman to sexual intercourse by sexual by deceat or abuse. But take note ha, tinaas na yung satur rape to 16. So this might be siguro kailangan ko kailangan ong i-edit. Yung definition is over 16 and under 18 by means of the seat. So yan yung ibig sabihin ng deficio. Mafa-file siya kahit walang complainant. So it can be filed by the police or by the state. Now qualified seduction. Um ba when we when we review yung qualified it changes the nature of the crime. Okay? So pagqualified that means yung ba kanina ah any male person lang tapos yyung victim is 12 or maybe 16 to 18. Pag qualified may certain individuals those with authority such as priest or teachers who seduce a virgin over 12 and below 18 or over 16 and under 18 to have sexual intercourse okay entising a woman to have sexual intercourse by deceit or abuse okay regardless of age or or reputation so iyan yung qualified for let’s say teacher okay ah niloko niya pina na kumbaga binigyan niya ng mga attractive attractive nuisance mga attractive offers yung 60 or yung 16 years old and then 16 gave her consent okay that’s already qualified seduction and it may also be it may also fall under RA 7610 which is child abuse no what is virginity virginity sa context nito it means that having chased character or good reputation. So medyo ano rin to it sounds old no? Kasi parang ah para maging para makasuhan mo yung ano yung offender dapat yung babae hindi malandi. May ganyan ba no? Dapat hindi sa may may chased character yung yung victim or good reputation. So meaning ba ag pag agag known siya to be you know promiscus hindi siya ma-file. So that’s that’s the question to be posed no. So that’s virginity. So again qualified seduction is committed by certain individuals like those in authority, priests, teachers who seduce a virgin over 12 and under 18 years of age or by a brother seducing his sister or a descendant seducing an ascendant regardless of age or reputation. Now let’s go to the next which is corruption of minors. Article 340. What is corruption of minors? Involves inducing a minor to abandon the home or to lead a desolute life. This is an exception to the private nature of crimes against stressity and can be produced prosecuted the official. This may apply sa ano yung old school na ginagawa rin nila yung yung nagtatanan ‘ ba pag minor yan nagtanan sila dahil in love sila and syempre yung nagtanan probably is already a adult no ah so abandoning home what the law protects is so that the minors will be within the premises or within the guidance of their parents of their guardians at bawal silang i kumbaga ilisan sa kanilang sa kanilang bahay by deceit okay by inducement okay force abduction what is force abduction the abduction of any woman against her will and with le designs or the abduction of a female under 12 years of age regardless of of leude design so abduction is the taking of a woman against her will borderline kidnapping siya or legal illegal detention and usually this is absorbed no abduction is taking away a person often against their will so ito yung yung medyo confusing force abduction versus kidnapping ano yung difference nilang dalawa so sa force abduction yung primary distinction niya is woman yyung victim and against her will and with leue design so kumbaga it’s still a crime against chastity kasi parang May may pagnanasa no? May pagnanasa ‘yung motive ng force abduction. Okay? So syempre kinunan niyo, kinuha ‘yung bata kinuha yung babae probably walang intention to rape no? Parang ano lang parang gusto lang siyang manyakan or or i gusto lang siyang pagnasaan. Okay, that could be force abduction alone. 1.48 rape is only between a man and a woman.
1.48 Now, meron ng rape na between man and a
